A builder opens the mail to find a demand letter alleging defects across an entire subdivision. These two situations look nothing alike, but in California they travel down the same legal road. That road is the Right to Repair Act, the statute most people in the industry simply call SB 800. The Right to Repair Act is codified in Civil Code sections 895 through 945.5. One feature of the Act that matters enormously to owners and often surprises builders is that in many situations, a homeowner can recover the cost of repairing a defect that violates a statutory standard even when that defect has not yet caused any other visible damage. For many years, the rule generally required actual resulting harm before a claim could move forward but the Act changed that, so as to allow owners to address certain defects before they grew into far more expensive problems down the line.
The Act however does not hand homeowners a ticket straight to the courthouse. Before a lawsuit can be filed, the owner generally has to give the builder written notice describing the claimed defects, along with a genuine opportunity to inspect the home and make repairs. The statute sets out a sequence with real deadlines covering how quickly the builder must acknowledge the claim, when the inspection happens, and how a repair offer is made and answered.
This process cuts both ways. A homeowner who ignores this process and races to file suit can see the case stalled or weakened. A builder who receives a proper notice and brushes it aside can lose the very protections the statute was designed to provide. The smart move for either side is to treat the notice and repair procedure as the serious, structured opportunity it is meant to be, because that is often where these disputes actually get resolved without the expense of a trial.
Construction defect claims have firm time limits. Civil Code section 941 sets an outside deadline of ten years from substantial completion for many claims. Shorter periods can apply to particular standards based on when a defect was discovered or reasonably should have been discovered. Because the clock that applies depends on the type of defect and the specific facts, both owners and builders are far better off having the timeline analyzed early rather than assuming there is plenty of time. A claim that was perfectly valid can vanish simply because the right deadline slipped past unnoticed.
For homeowners and homeowner associations, walking through the Act correctly is what preserves the claim and the right to recover the cost of repairs. For builders, developers, architects, and engineers, responding to a notice quickly and properly is frequently the difference between managing a contained repair and defending a sprawling, expensive lawsuit. The Act was written to push these disputes toward sensible resolution, but it only rewards the parties who understand it and use it the way it was intended.
